CALL FOR GENERAL ELECTION

AN ORDINANCE OF THE VILLAGE OF BAILEY’S PRAIRIE, TEXAS, CALLING THE ANNUAL GENERAL ELECTION OF OFFICERS FOR SAID VILLAGE; PROVIDING FOR A MUNICIPAL ELECTION PRECINCT AND DESIGNATING THE POLLING PLACE THEREOF; ESTABLISHING THE QUALIFICATIONS FOR CANDIDATES FOR THE OFFICE; PROVIDING FOR APPLICATIONS AND LOYALTY OATHS FOR CANDIDATES AND FIXING A FILING DEADLINE; PROVIDING FOR THE QUALIFICATION OF ELECTORS; APPOINTING OFFICERS OF SAID ELECTION AND DESIGNATING THE NUMBER OF CLERKS TO ASSIST IN CONDUCTING SAID ELECTION AND THE COMPENSATION TO BE PAID THE ELECTION JUDGE AND CLERKS; PROVIDING FOR ABSENTEE VOTING; PROVIDING FOR A RATIFICATION AND CONFIRMATION BY THE MAYOR OF SAID ACTION TAKEN BY THIS ORDINANCE; AND PROVIDING A METHOD OF PUBLICATION FOR THIS ORDINANCE.

BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE VILLAGE OF BAILEY’S PRAIRIE, TEXAS:

SECTION ONE – ANNUAL GENERAL ELECTION CALLED

Pursuant to provision of Section 22.023, et seq., Texas Local Government Code, the Mayor and Board of Aldermen of the Village of Bailey’s Prairie, Texas hereby order and ordain, respectively, that an annual election shall be held in and throughout the Village of Bailey’s Prairie, Texas, on the second Saturday in May, 2015, being the 9th day of May, A.D. 2015, between the hours of 7:00 o’clock am and 7:00 o’clock pm., for the purpose of electing the following named officers of the Village of office; to-wit:

Alderman – JD Ponton

Alderwoman – Judith McElya

Alderwoman – Michelle Powless

SECTION TWO – MUNICIPAL ELECTION PRECINCT AND POLLING PLACE

The proposed voting locations are listed in Attachment A of this ordinance.  In the event a voting location is not available, the County Clerk’s Election Department will arrange for use of an alternate location with the approval of the Political Subdivision.  The Elections Department shall notify the Political Subdivision of any changes from the locations listed in Attachment A.   If polling places for the May 9, 2015, joint election are different from the polling place used by Political Subdivision in it’s most recent election, Political Subdivision agrees to post a notice no later than May 9, 2015, at the entrance to any previous polling place in the jurisdiction stating that the polling location has changed and stating the political subdivision’s polling place names and addresses in effect for the May 9, 2015 election.

SECTION THREE – CANDIDATES, APPLICATIONS AND FILING FEE

Everyone who has attained the age of 18 years, who has resided within the incorporated limits of the Village of Bailey’s Prairie, Texas, for a period of six months next preceding the last day on which candidates application for a place on the ballot could be delivered to the Mayor, as hereinafter provided, shall be eligible to become a candidate for the office of Aldermen of the Village of Bailey’s Prairie, Texas, by filing a sworn application in writing containing the matters set out in Section 144.005, Texas Election Code with the Secretary of the Village of Bailey’s Prairie, Texas, no sooner than the 71st day and later than 5:00 o’clock pm on the 45th day preceding the date hereinabove specified of said election, being January 28, 2015, and February 27, 2015, respectively.

SECTION FOUR – ELECTORS

Every person eligible to vote under the provisions of the Texas Election Code who is a resident of the Village of Bailey’s Prairie, Texas, and who is registered to vote in the precinct where and on the day on which he or she votes shall be entitled to vote at said election.

SECTION FIVE – ABSENTEE VOTING

The proposed early voting locations, dates, and times are listed in Attachment A of this Ordinance.

SECTION SIX – METHOD OF VOTING AND CONDUCTING ELECTION

All absentee voting and all voting on the day named above or the holding of said general annual election shall be by means of paper ballots.  This manner of holding said election will be governed by the laws of the State of Texas governing general elections and as provided in this Ordinance.  The Secretary of the Village of Bailey’s Prairie, Texas, is hereby authorized and directed to procure the necessary supplies for said election, and if further authorized and directed to do and perform any and all other acts required by the Texas Election Code of City Secretaries conducting municipal elections and to do and perform any and all other acts required by the applicable laws of the United States of America.

SECTION SEVEN – NOTICE OF ELECTION

The Mayor of the Village of Bailey’s Prairie, Texas, is hereby authorized and directed to issue a notice of said election, to cause the same to be posted for at least 21 days prior to the date named above for the holding of said general annual election at the place within the incorporated limits of the Village of Bailey’s Prairie, Texas, normally used to post notices of meetings of the Board of Aldermen, and to be published in the Brazosport Facts, a newspaper published in Brazoria County, Texas, having a general circulation within the corporate limits of said Village not less than ten nor more than 30 days before the date named above for the holding of said general annual election.

SECTION EIGHT – RATIFICATION AND CONFIRMATION BY MAYOR

By signing this Ordinance, the undersigned Mayor of the Village of Bailey’s Prairie, Texas, hereby ratifies and confirms as his action all matters hereinabove recited which by law come within his jurisdiction.

SECTION NINE – EFFECTIVE DATE

This Ordinance shall be effective immediately upon its passage and approval.
