AN ORDINANCE OF THE VILLAGE OF BAILEY’S PRAIRIE, TEXAS, MAKING FINDINGS OF FACT; ADOPTING A BUDGET FOR THAT VILLAGE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2015, AND ENDING SEPTEMBER 30, 2016; AND PROVIDING A SEVERANCE CLAUSE AND EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE VILLAGE OF BAILEY’S PRAIRIE, TEXAS:
1. The Board of Aldermen of the Village of Bailey’s Prairie, Texas, (“the Village”) makes the following findings of fact:
a. In compliance with section 102.002 of the Texas Local Government Code, the Mayor of the Village prepared a proposed budget for the fiscal year beginning October 1, 2015, and ending September 30, 2016, for the Village.
b. The Mayor filed said proposed budget with the Village Secretary at least thirty-one days before this ordinance is being passed and at least sixteen days before the Board of Aldermen held a public hearing on the budget, all in compliance with Chapter 102 of the Texas Local Government Code.
c. The proposed budget was posted on the Village’s internet website and was available for inspection by any person, in compliance with Chapter 102 of the Texas Local Government Code.
d. Public notice of the date, time, and place of the hearing on the budget to be conducted by the Board of Aldermen was posted in The Facts, a newspaper of general circulation in Brazoria County, the county in which the Village is located, not earlier than the thirtieth or later than the tenth day before the date of the hearing, in compliance with Chapter 102 of the Texas Local Government Code.
e. Notice of each meeting of the Board of Aldermen and the public hearing concerning any action on the budget was posted at the Village of Bailey’s Prairie Village Hall at least seventy-two hours before that meeting or hearing, as applicable, in compliance with the Texas Open Meetings Act.
f. This ordinance is being passed after the public hearing held on the budget in compliance with Chapter 102 of the Texas Local Government Code.
g. All procedures, prerequisites, and requirements of law concerning this ordinance and the budget herein have been satisfied.
2. Adoption of Budget
The Board of Aldermen of the Village of Bailey’s Prairie, Texas, hereby adopts the attached budget for the Village for the fiscal year that begins October 1, 2015. The Board of Aldermen hereby finds that any changes from the budget originally proposed by the Mayor to the budget adopted by this ordinance are warranted by the law and are in the best interest of the Village’s taxpayers.
3. Severance Clause
If any part of this ordinance, of whatever size, is ever declared invalid or unenforceable for any reason, the remainder of this ordinance shall remain in full force and effect.
4. Effective Date
This Ordinance shall be effective immediately upon its passage and adoption.
